By using this website or engaging our services, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the site or services. Mactrain Personal Training & Player Development, LLC ("Mactrain," "we," "us"), founded by Nevin McCaskill, operates in Conyers, Georgia.
1. Services
Mactrain offers personal training, small-group and HIIT classes, sports stretching, offensive-line training, youth and high-school athlete development, and gym or event-space rentals. Descriptions on the site are for general information and may change.
2. Eligibility and Minors
You must be at least 18 to enter into these Terms. If the participant is under 18, a parent or legal guardian must agree to these Terms and provide all consents on the minor's behalf, including consent to be contacted and consent to participate.
3. Health, Fitness Disclaimer & Assumption of Risk
Physical exercise carries inherent risks, including risk of serious injury or, in rare cases, death.
You should consult a physician before beginning any exercise program, especially if you have a medical condition or injury, are pregnant, or take medication. Information on this site and from our staff is for general fitness purposes only and is not medical advice; we are not medical providers, and nothing here diagnoses or treats any condition.
You voluntarily participate at your own risk and represent that you are physically able to participate. Before in-person training begins, you (or a minor's parent/guardian) will be asked to complete and sign a separate liability waiver, assumption-of-risk, and health-history (PAR-Q) form, which governs in-person participation. These online Terms do not replace that signed document.
4. No Guarantee of Results
Fitness outcomes depend on many individual factors. Individual results vary, and testimonials or before/after images shown on this site are not a promise or guarantee that you will achieve similar results.
5. Scheduling, Payments, and Cancellations
Sessions are booked in advance and are subject to availability. Fees are due at the time of booking or per your package terms. Our cancellation, rescheduling, no-show, and refund policy will be provided to you at the time of booking and in your training agreement.
6. Communications Consent
By submitting our contact form or providing your number, you consent to receive calls (including automated or AI-assisted calls and pre-recorded or artificial-voice messages) and text messages from Mactrain, as described in our Privacy Policy. Consent is not a condition of purchase. Reply STOP to opt out of texts; contact us to opt out of calls. Message and data rates may apply.
7. Photos, Testimonials, and Media Release
We use client images, testimonials, and athlete achievements only with permission. If you agree to be featured, you may sign a media release allowing Mactrain to use your (or your minor's) name, image, and story in marketing. You may withdraw future use by contacting us.
8. Acceptable Use & Intellectual Property
You agree to provide accurate information, to use the site lawfully, and not to disrupt or misuse it. All site content — text, logos, photos, and videos — is owned by Mactrain or its licensors and may not be used without permission.
9. Third-Party Services
Our site and lead system rely on third-party providers (for example, Netlify, Airtable, Twilio, ElevenLabs, and n8n). We are not responsible for third-party acts, outages, or their terms.
10. Disclaimer of Warranties
The site and services are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law.
11. Limitation of Liability
To the fullest extent permitted by law, Mactrain and its owner, staff, and contractors will not be liable for any indirect, incidental, special, or consequential damages, or for injury arising from voluntary participation in physical activity, except where such limitation is prohibited by law. This section does not limit liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify and hold harmless Mactrain from claims arising out of your use of the site or services or your breach of these Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Rockdale County, Georgia.
14. Changes to These Terms
We may update these Terms from time to time. Continued use after changes means you accept them.
